War crimes? No. Crimes against humanity? Yes.
Difference? While both are against the Rome Statute, they are in fact under different articles. Why? Some things are crimes that only apply when done by soldiers in war, while others are crimes against all of humanity when done irrespective of whether any party was a soldier or not.

Words have meaning, and it is important to be accurate in what is said, especially in the legal context. It’d be a shame if the scope of who is held accountable for ICE is limited because of a technicality
